Terms of Use

1. Acceptance of Terms

By accessing or using the Drawgg platform ("Platform"), available at drawgg.com.br, you agree to comply with these Terms of Use. If you do not agree with any part of these terms, you should not use the Platform. These terms constitute a legally binding agreement between you and Drawgg.

2. Service Description

Drawgg is a monetization platform for streamers that allows:

• For Streamers: Receive payments from viewers who want to draw on screen during live broadcasts on platforms like Twitch, Kick and YouTube
• For Viewers: Send drawings that appear on the streamer's broadcast upon payment, with prices based on drawing size and display duration

3. Eligibility

To use the Platform, you must: be at least 18 years old; have legal capacity to enter into binding contracts; provide true, accurate and complete information during registration; keep your account information up to date. When registering as a streamer, you must also meet identity verification requirements for receiving payments.

4. User Accounts

You are responsible for:

• Maintaining the confidentiality of your access credentials
• All activities performed on your account
• Immediately notifying of any unauthorized use
• Providing accurate information for identity verification (CPF, address, phone)

We reserve the right to suspend or terminate accounts that violate these terms or show suspicious activity.

5. Payments and Fees

5.1 Pricing

Streamers set their own prices for drawings, based on: cost per square pixel (drawing area) and cost per second of display. Prices are shown to viewers before payment confirmation.

5.2 Platform Fee

Drawgg charges a 7% fee on each transaction. The streamer receives 93% of the amount paid by the viewer.

5.3 Payment and Withdrawal Methods

We accept payments via PIX and credit card through Mercado Pago. Withdrawals can be made via PIX or Mercado Pago, subject to a minimum of R$ 50.00 for PIX withdrawals accumulated on the platform.

5.4 Refunds

Payments for drawings are final and non-refundable, except in cases of proven technical failure of the Platform that prevents the drawing from being displayed. Refund requests must be made within 7 days of the transaction.

6. User Content

6.1 Content Responsibility

You are solely responsible for drawings and content you send through the Platform. By submitting content, you declare that you have all necessary rights to it.

6.2 Prohibited Content

It is strictly prohibited to send drawings or content that:

• Is illegal, defamatory, obscene or pornographic
• Promotes discrimination, hate or violence
• Violates copyrights, trademarks or intellectual property
• Contains spam, malware or malicious links
• Harasses, intimidates or threatens others
• Violates streaming platform policies (Twitch, Kick, YouTube)

6.3 Moderation

Streamers have control over the drawing queue and can reject inappropriate content. Drawgg reserves the right to remove content and suspend users who violate these rules.

7. Intellectual Property

The Platform, including its design, code, logos and original content, is owned by Drawgg and protected by intellectual property laws. You receive a limited, non-exclusive, revocable license to use the Platform in accordance with these Terms. By submitting drawings, you grant Drawgg a license to display, store and transmit that content as necessary to operate the service.

8. Disclaimer of Warranties

The Platform is provided "as is" and "as available". We do not guarantee that the service will be uninterrupted, secure or error-free. We are not responsible for: interruptions or technical failures; loss of data or revenue; actions of third parties, including streaming platforms; user-generated content.

9. Limitation of Liability

To the maximum extent permitted by law, Drawgg shall not be liable for indirect, incidental, special or consequential damages resulting from use of the Platform. Our total liability is limited to the amount paid by you in the last 12 months or R$ 1,000.00, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless Drawgg, its directors, employees and partners from any claims, losses or damages arising from: your use of the Platform; content you submit; violation of these Terms; violation of third-party rights.

11. Tax Compliance

Streamers are responsible for complying with their tax obligations related to earnings obtained through the Platform. Drawgg may provide earnings reports to assist with tax filing, but does not offer tax advice. We recommend consulting an accounting professional.

12. Terms Modifications

We may modify these Terms at any time. Significant changes will be communicated by email or notice on the Platform at least 30 days in advance. Continued use after changes constitutes acceptance of the new terms.

13. Termination

You may close your account at any time. We may suspend or terminate your account for violation of these Terms. After termination, you may still withdraw pending balances, subject to minimum withdrawal rules and identity verification.

14. Governing Law and Venue

These Terms are governed by the laws of the Federative Republic of Brazil. Any dispute shall be submitted to the courts of São Paulo, SP, to the exclusion of any other, however privileged.

15. General Provisions

If any provision of these Terms is found to be invalid, the remaining provisions shall remain in effect. Failure to exercise any right does not constitute a waiver. These Terms constitute the entire agreement between you and Drawgg regarding use of the Platform.
